Project Requestor/ Customer Agreement

This Project Submission Customer Agreement (hereinafter referred to as the "Agreement") is entered into between [Customer Name], the customer (hereinafter referred to as the “ You” "Customer"), and The KIM People Limited, the provider of Mr.KIM mobile app (hereinafter referred to as the "App"), on this [Date].

This Project Submission Customer Agreement constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and The KIM People Limited, and concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all the project submisson customer agreement HEREIN. IF YOU DO NOT AGREE WITH ALL the project submisson customer agreement HEREIN, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. Scope of Agreement:
   1. The Customer agrees to use the App to submit project requests and communicate with Mr.KIM support staff for their services.
   2. Mr.KIM App facilitates the connection between the Customer and professional service provider, allowing for project submission and communication.
2. Professional Service Provider Selection:
   1. Mr.KIM App provides a platform to connect the Customer with handymen based on their availability, skills, and proximity.
   2. The Customer has the option to review professional Service Provider profiles, ratings, and reviews to make an informed decision when selecting a professional Service Provider.
3. Project Description:
   1. The Customer agrees to submit the project description and requirements to  Mr.KIM App for evaluation and consideration.
   2.  Mr.KIM App will review the project details and provide a quote or proposal based on the provided information.
   3. The Customer acknowledges that the handymen rely on the provided information for project evaluation and decision-making.
4. Quote or Proposal:
   1.  Mr.KIM App will provide a quote or proposal to the Customer, outlining the scope of work, deliverables, timeline, and pricing.
   2. The quote or proposal shall remain valid for a specified period, as mentioned in the document.
5. Project Acceptance:
   1. The Customer shall review the quote or proposal and notify  Mr.KIM App of their acceptance or rejection within the specified timeframe.
   2. Upon acceptance, the Customer acknowledges and agrees to the terms and conditions outlined in the quote or proposal.
6. Communication and Project Execution:
   1. The App enables secure communication channels between the Customer and the selected professional service provider for discussing project details and scheduling.
   2. The Customer acknowledges that the App acts as a facilitator and is not responsible for the actual execution of the project by the professional services provider.
7. Feedback and Ratings:
   1. The Customer may have the opportunity to provide feedback and ratings for the professional service provider through the App.
   2. The Customer agrees to provide honest and constructive feedback to help maintain the quality and reputation of the professional service provider community.
8. Project Timeline and Milestones:
   1.  Mr.KIM App will establish a project timeline, including key milestones and deliverable dates.
   2. The Customer agrees to provide any necessary information, materials, or approvals in a timely manner to ensure the project progresses as scheduled.
9. Payment Terms:
   1. The Customer agrees to pay the agreed-upon fees or charges as specified in the quote or proposal.
   2. Payments shall be made according to the payment schedule outlined in the quote or proposal, unless otherwise agreed upon in writing.
   3. Mr.KIM App will facilitate secure payment options for the customer
   4. The final pricing, including labor, materials, and any additional charges, will be communicated by Mr.KIM App support staff.
10. Changes and Modifications:
    1. Any changes or modifications to the project scope, deliverables, timeline, or pricing must be agreed upon in writing by both parties.
    2. Additional charges may apply for any changes or modifications requested by the Customer, subject to  Mr.KIM App's approval.
11. Warranty and Liability:
    1.  Mr.KIM App warrants that the work performed will be done in a professional and workmanlike manner.
    2. The Customer agrees to promptly notify  Mr.KIM App of any issues or concerns regarding the completed work, allowing  Mr.KIM App an opportunity to rectify the situation.
12. Liability and Insurance:
    1.  Mr.KIM App maintains appropriate liability insurance coverage for its operations.
    2. The Customer understands that  Mr.KIM App's liability is limited to the value of the work performed and does not extend to any damages or losses beyond the scope of the project.
13. Intellectual Property:
    1. The Customer retains ownership of any intellectual property rights associated with their project materials, content, or data.
    2.  Mr.KIM App may retain rights to use project-related materials or deliverables for promotional purposes, with the Customer's consent.
14. Confidentiality:
    1. Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the project submission and execution. The Customer agrees not to disclose any confidential information of  Mr.KIM App without prior written consent.
15. Termination:
    1. Either party may terminate the Agreement upon providing written notice to the other party, subject to the terms and conditions outlined in the quote or proposal.
    2. In the event of termination, the Customer shall be responsible for any outstanding payment due for services rendered prior to termination.
16. Governing Law and Jurisdiction:

1. This Agreement shall be governed by and interpreted in accordance with the laws of Kenya and East African Community.
2. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Kenya and East African Community.

17. Entire Agreement:

1. This Agreement constitutes the entire understanding between  Mr.KIM App and the Customer and supersedes any prior agreements, written or verbal, relating to the subject matter herein.

By using the App and submitting projects through it, the Customer acknowledges and agrees to the terms and conditions outlined in this Project Submission Customer Agreement.
