Terms and conditions for requesting for services.

These Terms and Conditions ("Terms") govern your use of The KIM People Limited service provided through our mobile application ("App" “ Mr.KIM”).

These Terms and conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and The KIM People Limited, and concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all the MOBILE APP USERS’ Terms and conditions for reqeusting services HEREIN. IF YOU DO NOT AGREE WITH ALL THE MOBILE APP USERS’ TERMS AND CONDITIONS FOR REQUESTING FOR SERVICES  HEREIN, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY

1. Service Description:

1. Our App facilitates the connection between users ("Customers") in need of services ("Services") and professional service providers ("providers").
2. We do not provide the Services directly but act as a platform to connect Customers and professional service providers.
3. We do not endorse or guarantee the quality, reliability, or suitability of any professional service provider or Services provided.

2. Eligibility:

1. To use our App and access the Services, you must be at least 18 years old and capable of entering into a legally binding agreement.
2. You agree to provide accurate, complete, and updated information during registration and throughout your use of the App.

3. Service Requests:

1. Customers may submit service requests through the App, specifying the nature of the service needed, location, and desired appointment time.
2. Professional service provider will have the option to bid for the service request based on availability and their discretion.

4. Service Agreement:
   1. Once a professional service provider accepts a service request, a contractual agreement is formed between the Customer and the professional service provider.
   2. The professional service provider  will perform the Services to the best of their ability, utilizing their expertise and professional judgment.
   3. The Customer agrees to provide a safe working environment and access to necessary tools and materials, if applicable.
5. Payments:

1. Payment for Services will be made through the App using the provided payment gateway and you agree to the terms of payment.
2. The App may charge a service fee or commission for facilitating the transaction.
3. All payments are non-refundable unless explicitly stated otherwise.

6. Liability:

1. We do not assume any liability for the actions, omissions, or behavior of Handymen or Customers.
2. Professional service providers are independent contractors and are solely responsible for their actions, including any damages or losses caused.
3. Customers are responsible for assessing the suitability of the professional service provider and the Services offered.

7. Intellectual Property:

1. Our App and its contents, including but not limited to logos, trademarks, and software, are protected by intellectual property laws.
2. You agree not to use, reproduce, modify, or distribute any content from the App without prior written consent.

8. Termination:

1. We reserve the right to suspend or terminate your access to the App at any time without prior notice.
2. Upon termination, any pending service requests or ongoing agreements between Customers and professional service provider shall remain valid.

9. Modifications:

1. We reserve the right to update or modify these Terms from time to time.
2. By continuing to use the App after the changes are implemented, you agree to be bound by the revised Terms.

10. Governing Law and Jurisdiction:

1. This Agreement shall be governed by and interpreted in accordance with the laws of Kenya and East African Community.
2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Kenya.

11. Entire Agreement:

1. This Agreement constitutes the entire understanding between  Mr.KIM App and the Customer and supersedes any prior agreements, written or verbal, relating to the subject matter herein.
