Terms and conditions-Bidding for a service job

These Terms and Conditions ("Terms") govern the process of bidding for service jobs through our mobile application ("App").

These Terms and Conditions - Bidding for a service Jobs constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and The KIM People Limited, and concerning your access to and use of the Services. You agree that by participating in the bidding process, you have read, understood, and agreed to be bound by all the MOBILE APP USERS Term and conditions-bidding for s service job HEREIN. IF YOU DO NOT AGREE WITH ALL THE MOBILE APP USERS’ TERMS AND CONDITION-BIDDING FOR A SERVICE JOB HEREIN, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY

Please read  carefully before submitting your bids.

1. Eligibility:

1. To participate in the bidding process, you must be a registered user on our App and meet any additional eligibility criteria specified.
2. You agree to provide accurate, complete, and updated information during registration and throughout your use of the App.

2. Bidding Process:

1. The App will provide you with a list of available service jobs posted by users ("Customers").
2. You may submit a bid for a job, accepting the budget price for the customer, estimated time, and any other relevant details requested.
3. Bids must be submitted within the designated timeframe specified in the job posting.

3. Job Acceptance:

1. The Customer retains the right to accept or reject any bids received for their posted job.
2. If your bid is accepted, a contractual agreement is formed between you and the Customer for the provision of the service services.
3. You agree to honor your bid and complete the job to the best of your ability, utilizing your expertise and professional judgment.

4. Payment:

1. Payment for the job will be made as per the terms agreed upon between you and the Mr.KIM.
2. The App may facilitate the payment process; however, any disputes regarding payments should be resolved directly between you and Mr.KIM
3. You accept that Mr.KIM will hold 25% commission of the total amount of the job you have successfully secured via Mr.KIM app.
4. You agree to comply with any applicable tax regulations and report your earnings accurately.

5. Liability:

1. We do not assume any liability for the actions, omissions, or behavior of Customers or professional service provider participating in the bidding process.
2. As a Service, you are responsible for your actions, including any damages or losses caused during the provision of your services.
3. You understand and acknowledge that the selection of bids and engagement with Customers is solely at your discretion.

6. Intellectual Property:

1. Our App and its contents, including but not limited to logos, trademarks, and software, are protected by intellectual property laws.
2. You agree not to use, reproduce, modify, or distribute any content from the App without prior written consent.

7. Termination:

1. We reserve the right to suspend or terminate your access to the bidding process at any time without prior notice.
2. Upon termination, any pending bids or ongoing agreements between you and Customers shall remain valid.

8. Modifications:

1. We reserve the right to update or modify these Terms from time to time.
2. By continuing to participate in the bidding process after the changes are implemented, you agree to be bound by the revised Terms.

9. Governing Law and Jurisdiction:

1. This Agreement shall be governed by and interpreted in accordance with the laws of Kenya and East African Community.
2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Kenya.

10. Entire Agreement:

1. This Agreement constitutes the entire understanding between  Mr.KIM App and the Customer and supersedes any prior agreements, written or verbal, relating to the subject matter herein.

 

By adhering to these Terms and Conditions-Bidding for a service job, you demonstrate your commitment to providing exceptional professional services and fostering trust and satisfaction among our customers.

All professional service providers of Mr.KIM are expected to familiarize themselves with these Terms and Conditions-Bidding for a service job and abide by its principles. Failure to comply with this Terms and Conditions-Bidding for a service job may result in consequences, including the suspension or termination of your access from Mr.KIM mobile app. By participating in the bidding process, you acknowledge that you have read, understood, and agreed to these Terms and Conditions- Bidding for a service job.
